Governing Law and Jurisdiction Agreement (GLJA)
Protecting healthcare organizations and physicians when treating non-residents of Canada
Healthcare Insurance Reciprocal of Canada (HIROC) and the Canadian Medical Protective Association (CMPA) have jointly developed two Governing Law and Jurisdiction Agreement forms for use by Healthcare Organizations and Physicians in Private Practice, respectively.
Healthcare organizations and physicians should make reasonable efforts when treating non-residents of Canada to ensure a Governing Law and Jurisdiction Agreement is completed before treatment is initiated. These forms are designed to assist in establishing Canadian jurisdiction for any potential legal actions that may result from care or treatment provided by healthcare organizations or Canadian physicians to non-residents.
Please note that physicians providing healthcare and treatment in a healthcare organization setting are not required to also have the Physicians in Private Practice form completed. Physicians working in a healthcare organization setting are specifically included in the Healthcare Organization form and would receive the benefit of that form in assisting in establishing Canadian jurisdiction for any potential legal action that may result.
